Prosecutor, Pam Smith, said police stopped Burke after he drove a Combo van without lights on May 30 about 1am.

A breath test showed 75 micrograms of alcohol in her body – 35 is the limit.

David Charnley, defending, said Burke, who had no previous convictions, had been drinking in the afternoon.

He then went home and had something to eat.

A friend then invited to come round and believing he was fit to drive he went off in his grandfather’s van.
