Man given restraining order banning him from contacting his own mother

Jason McMahon, 40, had already been told not to go to his mother’s house and a police information notice was issued in July last year.

Wigan And Leigh Magistrates’ Court heard yesterday that he was an alcoholic and would bang on the door of Audrey McMahon’s house several times a day.

She used to give him money but then started giving him food instead, Tess Kenyon, prosecuting, said.

The notice worked at first, but McMahon started going back to the house, asking for money and food and calling her names.

On March 31, he banged on the door and was shouting and swearing.

Miss Kenyon said Mrs McMahon did now answer the door, but shouted for him to go away.

She heard him say he was going to smash up a car and windows, the court heard.

He also made threats towards neighbour Anthony Geoffrey Hayes after he told him to leave, the court heard.

His wife Elaine Hayes said in a statement that she was upset by his behaviour.

Miss Kenyon applied in court for a restraining order.

Defending, Kenny Ip said: “He accepts that the application was inevitable and he accepts that his behaviour has been inappropriate on this occasion.”

McMahon, of no fixed address, denied harassment without violence towards Mrs McMahon and using threatening or abusive words towards Mrs McMahon and Mr and Mrs Hayes.

But he was found guilty after a trial held in his absence and pleaded guilty to failing to surrender to bail.

Magistrates handed down an eight-week prison sentence, suspended for 12 months, with a rehabilitation activity requirement for 20 days.

A restraining order was put in place for two years banning him from contacting Mrs McMahon and Mr and Mrs Hayes, and he must not enter Chatsworth Close in Ashton-in-Makerfield.

McMahon was also told to pay £260 costs and an £80 victim surcharge.
